New council code aims to reduce busking complaints

BUSKERS and street entertainers in West Somerset are being given more protection from complaints under a new code of practice which has been launched by the district council.
The new code is intended to help performers avoid complaints and stay on the right side of the law.
Council licensing committee chairman Councillor Jenny Hill said buskers were sometimes reported as a public disturbance or annoyance, quite often without the buskers realising there was a problem.
If a performer was the subject of recurring complaints, the council would take action under the Environment Protection Act 1990 which could include seizure of musical instruments and amplifiers.
Councillor Hill said: “We would only resort to these measures if other forms of action had failed, as busking and other forms of street entertainment provide pleasure to many people. We want to see that continue.
“Our role is to ensure buskers maintain their place in creating a vibrant atmosphere and providing entertainment while staying within the law.
“That way, we are fulfilling our obligation to the performers and public alike.”
Under the new code of practice, anybody who is disturbed by busking should first approach the buskers to politely explain their concern before resorting to complaining to the council.
Councillor Hill said street entertainers were often unaware of the problem they might be causing, and most would happily reduce noise levels once alerted.
Street entertainment should only be reported West Somerset Council’s Licensing Team if a problem persisted.

Spot-checks operation on taxis to ensure public are safe at Christmas

A PRE-Christmas clampdown on taxi and private hire operators saw two vehicles taken off the road immediately for failing safety checks.
The operation was carried out jointly last week by West Somerset Council, police, and vehicle inspectors.
A total of 25 taxis and private hire vehicles were randomly stopped for spot-checks which were carried out at Minehead police headquarters.
Police motorcyclists rounded up hackney carriages up to eight-seats in size, and engineers from the Vehicle and Operator Services Agency (VOSA) made safety checks.
Of the two prohibition notices which were issued - preventing the operator trading immediately - one was lifted on the same day after minor remedial works by qualified mechanics.
Council licensing committee chairman Councillor Jenny Hill said: “Taxis are very much in demand at this time of year so we were pleased to discover the vast majority of operators are keeping their vehicles in a safe and sound condition, and meeting the strict standards for public hire vehicles.
“It is vital that there is no compromise in ensuring public safety, and that people can trust in the reliability of hire transport.”
Police, who conduct roadside checks on all vehicles to ensure they are roadworthy, taxed, and insured, urged motorists to conduct regular checks on their vehicles to ensure they complied with manufacturer and use regulations.
Inspector Carol Pearce said: “These checks are a regular occurrence in West Somerset.
“By working together with all agencies, we can ensure that when a member of the public gets into a taxi in West Somerset, it is completely roadworthy.
“I would urge all drivers of motor vehicles to regularly check their lights and ensure that the windscreen washes are topped up
“Keeping your vehicle safe and roadworthy is the best Christmas present you can give yourselves, your family, and your fellow humans.
“Stay safe over Christmas, if you drink - don’t drive.”

Christmas event planners urged to apply for their licences early

EVENT organisers and the owners of licensed premises are being reminded by West Somerset Council to apply for temporary event notices (TENs) now to ensure their Christmas celebrations are stress-free.
TENs apply to the sale of alcohol and regulated entertainments, such as live music.
Licensing committee chairman Councillor Jenny Hill said: “This year, Christmas Eve falls on a Wednesday, so people need to check the hours on their premises licence or club premises certificate for Wednesday evenings.
“Quite often, premises have earlier closing times during the week and, if this is the case, businesses will need to either apply for a temporary event notice or for a permanent variation to the licence if they wish to have longer opening hours.”
It takes a minimum of 10 clear working days, which excludes Bank Holidays and weekends, to process applications for TENs.
This means that applications for TENs for Christmas Eve must be received by December 9 at the latest.
However, the district council recommends applying for TENs a month in advance to ensure the deadline is not missed and that applications can be processed in plenty of time, leaving event organisers free to plan their celebrations.
Councillor Hill said: “The last thing the council wants to be is a killjoy because we appreciate all the hard work that goes into special festive events.
“However, Government legislation is clear on the timescales for processing TENs and local authorities have no discretion on accepting late applications.
“This is why we are urging people to apply now.
“With New Year’s Eve also falling on a Wednesday, people should check their licences to ensure they are covered for both dates.
“Also, not all licences provide for an extension of hours on New Year’s Day, so people need to check carefully, and apply for TENs accordingly.
“Any TEN that extends to past midnight is classed as two days out of the 15 days permitted within the calendar year.”
The council offices will be closed from 1 pm on Wednesday, December 24, until Monday, January 5, 2009.

Safety crackdown nets taxis and private hire vehicles

A SAFETY crackdown on private hire and taxi cabs in West Somerset has been carried out jointly by West Somerset Council, the police, and the Vehicle and Operator Services Agency (VOSA).
They joined forces for the operation last week, on Thursday, August 21, when 22 vehicles were rounded up by police motorcyclists and taken to Minehead police headquarters.
There, they were inspected by the council and VOSA.
Four prohibition notices - which stop the operator from trading with immediate effect - were issued.
Three notices were lifted after minor remedial work was completed by qualified mechanics, but one hackney carriage from outside the district had to return to its home town for remedial work.
District council licensing committee chairman Councillor Jenny Hill said: “We were pleased to find that the majority of private hire and taxi cabs were in a safe and sound condition, and those that did not meet the stringent standards only needed minor work to bring them up to scratch.
“However, it shows that we are not prepared to compromise public safety or public trust in the generally good service provided by our licensed operators.”
Police Inspector Carol Pearce said: “Road safety is an important issue for all road users, whether drivers, passengers, or pedestrians, and we were delighted to help our colleagues with this operation.
“All vehicles suffer general wear and tear, so we recommend that all drivers regularly check their vehicles to ensure that they comply with the construction and use regulations.
“Local police conduct roadside checks to ensure vehicles are roadworthy and appropriately insured and taxed.”

Town crier to open new-look Watchet Esplanade

THE official opening of a new-look Watchet Esplanade will be celebrated on Saturday with a packed programme of events.
West Somerset Council secured £138,380 of European Regional Development Funding (ERDF) and more than £51,000 from the Somerset Rural Renaissance Partnership to enhance the area alongside one of West Somerset’s best-loved historic ports.
The enhancement project included infrastructure such as market stalls to enable the town to host local farmers and craft markets, new seating, audio/visual equipment, a refurbishment of the current shelters to include an information point, new paving in some areas, railings, lamps, curved benches, planters, and new tree plantings to boost the overall appearance.
District council chairman Councillor Jenny Hill, who is also a Watchet town councillor, said: “We are delighted with the project.
“It is now a really good area for tourists and the local community to enjoy.
“We are looking forward to the opening and to The Esplanade hosting a range of other events for the benefit of everybody.”
Town council chairman, Councillor David Banks, said: “The open day is essentially a community day where local organisations can take advantage of the enhanced facility.”
The celebrations start at 11.30 am with the cutting of a ceremonial ribbon by Alec Danby, who has served Watchet as town crier for 20 years.
A samba band, balloon modelling, the Rattlebox Theatre, Raventale Giants, and wandering clowns are also lined up to keep the crowds entertained for the afternoon.
Other activities will include a climbing wall, trampolines, hair braiding, and face painting, as well as a vintage car display and a variety of stalls on The Esplanade.
West Somerset Council’s acting head of paid service, Adrian Dyer, said: “It is great to see this project come to fruition and to see The Esplanade being enjoyed by local people.
“As well as providing new seating and renovating the shelters and paving, there is now provision for the town to host markets which will attract more visitors to this lovely, historic seaside town.”
